In a case tried in the Lycoming County Court of Common Pleas in March of 2010, the jury refused to award damages where negligence was admitted by the defendant.  The case, Barone vs. Montgomery, was filed after a fender-bender accident in a parking lot. Mitchell Gallagher lawyer Gary Weber defended the case.

The plaintiff claimed that she had injuries in her neck, hip and knee after the accident.  However, she received minimal treatment after the accident, and had pre-existing degenerative arthritis.

The defendant agreed that he caused the accident, but did not believe that he caused any injuries.  The jury agreed, and refused to find liability or award damages.

The case was not appealed.
